Michael Riley of Florida was growing marijuana in a greenhouse on his property. Police received a tip and went to Riley's greenhouse to investigate but could not see into the greenhouse because of a wall and trees that were in the way. Police then used a helicopter to observe the greenhouse from an arial perspective and concluded that he was in possession of marijuana. Police used this information to obtain a search warrant and arrested Riley for possession of marijuana. Riley's request to suppress the evidence because the police violated his 4th Amendment rights by flying a helicopter over his property was approved.
The District Court of Appeals of Florida, Second District reversed the trial courts decision.
The appellate court certified the case to the Supreme Court of Florid, which reinstated the trial court's order to suppress the evidence.
The US Supreme Court ruled that police did not violate Riley's 4th Amendment protections because they entered public airspace and did not intrude or impede on his property.
