This case was pivotal in ascertaining the government’s authority to regulate free speech. It took place a few years after the Red Scare. Gitlow was a socialist American-citizen who was arrested for criminal anarchy after publishing a left-wing newspaper. The Supreme Court upheld Gitlow’s conviction, declaring that the government could regulate any speech that promoted the overthrow of federal or state systems. In doing so, it gave states the right to regulate free speech under certain circumstances.
