In 1982, the Charter of Rights and Freedoms was added to the constitution and it had an enormous impact of special education, more specifically, inclusion.
The charter explicitly states that education shall be provided to all "without discrimination based on race, national or ethnic origin, colour, religion, sex, age, or mental or physical disability". (Ellis & Axelrod, 2016, p. 20).
The Charter had specific implications for the Ontario school boards as it now made it no longer possible for schools to overrule parent's request to have their child mainstreamed, no matter their disability. (Ellis & Axelrod, 2016, p. 20).
