Marbury (midnight judge) wanted his commission to be able to start working. Madison refused to deliver commission.
Marbury loses.
Impact:
1. Supreme Court gained the power to declare laws unconstitutional - keep congress and president in check
2. Supreme Court become more powerful.
Chief Justice John Marshall showed that the Court could interpret the Constitution — and overrule laws that violated it.
strengthed by McCulloch v. Maryland (1819) and Gibbons v. Ogden (1824)
