4 jun 2018 ano - Masterpiece Cakeshop, Ltd. v. Colorado Civil Rights Commission (2018)
Descrição:
Phillips, the owner of Masterpiece Cakeshop in Colorado, refused to create a wedding cake for a gay couple due to his religious opposition to same sex marriage. The couple filed a complaint to the Colorado Civil Rights Commission (CCRC) who ruled against Phillips stating he is violating state law. Phillips appealed to the Supreme Court under the claim his 1st Amendment right to religious freedom and free speech was being violated.
The Supreme Court ruled in favor of Masterpiece Cakeshop in a 7-2 decision, finding the actions of the CCRC violated Phillips 1st Amendment protection to Free Exercise of religion. The Supreme Court argued the CCRC showed hostility towards Phillips' religion and that religious neutrality is needed for judicial decisions. This decision was tailored to match this case specifically and was not applied to all experiences of religious people providing services to LGBTQIA+ individuals.
