Requires the court, upon a determination that a defendant's mental capacity cannot be restored within 90 days, to release an offender, charged with misdemeanor (excluding misdemeanor domestic abuse) or a less serious controlled substances felony, to outpatient competency restoration or other appropriate treatment program.
