Beccaria believed that people need to know exactly what punishments are prescribed for various offenses if the law is to deter criminal behavior.

Declared that the punishment should fit the crime in one of two ways;

1) the severity of punishment should parallel the severity of harm resulting from the crime.
ex: an eye for an eye

2) The punishment should be severe enough to outweigh the pleasure obtainable from the crime.
