23 abr 2014 ano - White v Woodall

Descrição:

In January of 1997, a 16-year-old girl was kidnapped, raped, and murdered. Robert Woodall pled guilty to this crime but later at trial invoked his 5th Amendment right to avoid self-incrimination and had his judge ask the jury to not make any "adverse inference" from his decision to go back on his confession, but the Judge refused.

The case was taken to the Supreme Court in 2014 by Woodall claiming his 5th Amendment right was violated by the judge. He lost the case 6-3 because the Supreme Court said he lost his 5th Amendment right for no "adverse inference" after admitting to many details of the case.

Amendment in question: 5th
