Named for Democratic House representative Hale Boggs, the Boggs act set in place a minimum degree of time to be served for drug-related convictions. Users and traffickers became identical in the eyes of the law, and pot became the same thing as heroin for the purpose of punishment. Stoners found in possession could serve 2 to 5 the first time around, on top of a possible $2000 fine, and cost of bail if they got it. Second time around, they’d face 5 to 10 in prison, and on the third strike they were definitely out at minimum 10 to 20 years max in prison. Some in New York even proposed that anyone dealing drugs be given a minimum life sentence, but it never caught on. These restrictions were even further expanded on via the acts passed in the years to come: the Narcotics Control Act in ‘56, and the Comprehensive Drug Abuse Prevention and Control Act in ‘70.
