This is a landmark supreme court case in which the right of same sex marriage was given to the american people. They can now receive the recognition and benefits of being spouses just like heterosexual marriage. This is an example of how the judicial branch can check the legislative branch. It shows how the united states government has checks and balances in favor of equality and freedom of the american people. Congress put through the DOMA act, which recognized marriage and the federal benefits involved to be between a man and a woman, and president bush signed it into law. The Supreme court ruled this was unconstitutional and removed it. They ruled that same sex marriage is protected under the 14th amendment, equal protection for all citizens under the law. This shows that checks and balances do work in maintaining our rights as citizens.
