Description:

Dale was an assistant scoutmaster for the Boy Scouts of America (BSA) in New Jersey, but was removed from his position after coming out as gay publicly. The BSA cited anti-homosexuality policies in revoking his membership. Dale argued his removal as scoutmaster violated New Jersey's public accommodation law which prohibited discrimination based on sexuality.

The New Jersey court ruled in Dale's favor, but the case was brought to the Supreme Court by BSA. The Supreme Court ruled in BSA's favor 5-4, claiming the New Jersey anti-discrimination law violated BSA's 1st Amendment rights. This was upheld under expressive association, as the Supreme Court ruled BSA has a right to choose who to associate their organization with. Including Dale would inhibit BSA's ability to express their views and would amount to forced inclusion.
