Description:
It refers to FDR’s plan to control SCOTUS. He wanted to control the court because it was ruling (7 out of 9 times) that the New Deal was unconstitutional and that the federal gov was exceeding its constitutional authority. FDR believed SCOTUS did not represent the American people (he knew that the majority wanted the ND). So he came up with this scheme. The official name was the “Court Reform Bill.” FDR claimed that SCOTUS was falling behind with their work load. He proposed that for every judge over 70, an additional judge will be appointed (by FDR). This was the first time his fellow democrats opposed him. It didn’t pass, but many SCOTUS judges died in FDR’s later terms (he would appoint 9 total).
