Description:

Benjamin Gitlow was convicted of violating the New York Criminal Anarchy law, which made it a crime to encourage a violent overthrow of government. Gitlow claimed his 1st amendment was infringed upon. Incorporation had not yet happened, meaning the bill of rights only applies to federal crimes, but not state crimes. This case extended provisions of the 1st amendment to the 14th amendment, meaning federal protections apply to states as well as national government.
