Description:

The court case Gitlow vs. New York challenged the Bill of Rights 1st Amendment: freedom of religion, speech, press, assembly, and redress of grievances. The United States viewed Benjamin Gitlow as a threat, due to his belief in a type of government that the United States did not practice called anarchism. He was charged with violating “Anti Anarchist” lawas because of a pamphlet he published and distributed which degraded the US government and preached anti-government views. Gitlow fought back with his 1st Amendment right, but due to his time, place, and manner for his “freedom of speech” Gitlow was found guilty hateful speech towards the government, along with preaching anti-governmentalism.
