Description:

Gitlow vs New York was a famous court case that established freedom of speech (for political matters) at a state level. Before this case at the state level one did not have freedom of speech the Bill of Rights only applied on a federal level. That means people had no right to an attorney or a warrant. Gitlow was arrested on the charge of criminal anarchy because of a pamphlet he wrote about communism. The state of New York sentenced him to 5-10 years in jail. Because of nativism he was able to go to court with this case 3 years later when he was released on bail.
