Description:

Benjamin Gitlow was considered by society as a potential anarchist. The Unites States government saw him as a threat because he believed in a form of government that America did not have. He was later charged with being in violation with Anti Anarchist laws, this was because he gave out newspapers and magazines with anti-government views and often criticized the American government. Gitlow v. New York was a case where Gitlow was in violation of anti-government speech. He claimed that New York had taken away his constitutional rights. The verdict was that Gitlow was guilty. But, they also decided that state governments cannot deny citizens human rights that are in the Constitution. The 1st Amendment did not protect Gitlow in this case.
