1 déc. 2020 - Bond v. City of Tahlequah
Description:
U.S. Court of Appeals, Tenth Circuit
Summary:
Joy Rollice called 911 on her ex-husband, Dominic Rollice, who was intoxicated and causing Joy to feel unsafe. Officers Brandon Vick, Josh Girdner, and Reed arrived and confronted Dominic, who grabbed a hammer from the garage. Dominic approached the officers, and Officer Reed pulled out a taser. Dominic moved the hammer in some way behind his head, and Officers Vick and Girdner fired multiple shots. Dominic doubled over, prompting more shots from Girdner, and later died in the hospital. Dominic’s estate appealed the decision of the officers receiving summary judgement for their actions.
Decision:
The officers did not receive qualified immunity, and the case was given back to the lower courts for trial proceedings.
