Description:

Police received an anonymous tip that Ciraolo was growing marijuana in his yard. He had an inner and outer fence around the property, so police flew a plane at 1,000 feet over his home and saw the marijuana plants.

The Supreme Court had to decide if the warrantless flying of the place 1,000 feet over the home constituted an illegal search.

The Court held that this was not in violation of the Fourth Amendment. They held that in a time period where air travel was common, Ciraolo could not have expected his plants to be protected from plain view.
