1 janv. 1857 - Dred-Scott Ruling

Description:

Dred Scott, a slave whose master died in Wisconsin, sues his new master for claiming ownership of him, despite Scott living in a 'free' state. The issue is taking all the way to the Supreme Court, where they decide against Dred Scott. However, Chief Justice Tanney goes further, issuing a three-part statement. He said that, due to the Full Faith & Credit Clause, Wisconsin must honor Missouri's laws regarding slavery. He also claimed that no African American is, or ever can be, a citizen (meaning they can't sue), and even if they could sue, the Missouri Compromise violates the 5th Amendment right to property.
