Description:

IDEA was originally passed in 1975 as the Education for All Handicapped Children Act, but was renamed to be IDEA in 1990. IDEA is a federal law that ensures that public school provide a free and appropriate public education to children with disabilities (FAPE). IDEA also ensures that children with disabilities are prepared for both employment and independent living, as well as the requirement that students with disabilities be education in the least restrictive environment possible. With IDEA, early intervention and special education programs are required to develop plans for the services that a child and their family will receive and the goals for the child in their years of school. IFSPs are made for children ages birth to 2, and IEPs are for children older than 2 that outline the processes and the documents that the family members and professionals will use to help the child succeed in school. An important court case relating to IDEA is the Honig v. Doe case that occurred 13 years later in 1988. Doe was a student that was expelled from school due to disruptive behavior that had to do with the student's emotional and behavioral disability. The court ruled in favor of the student, determining that under IDEA, students with disabilities have the right to not be expelled or suspended for more than 10 days if the behavior is a result of their disability. This ensures that students are not denied education based on their disabilities, and required that schools use other methods like appropriate intervention and supports besides punishment to attempt to resolve behaviors of students with disabilities.
