The Individuals with Disability Act of 2004 was created for dual reasons. The first purpose was to assure that the unique educational needs of each student was met in a way that prepared them for future education, employment, and independent living to assure the highest quality of life for each child after their schooling ended. The second purpose was to assure that the rights of the child and their parents were safeguarded. In 1975 Congress found that poverty stricken African-American children were over-represented in special education. This has been present throughout till the 2004 amendment finally was amended to protect the rights of special educational needs of student and parents.
