Description:

Reduces from a maximum six months jail to a maximum 15 days jail the penalty for a first offense of possession of less than 14 grams of marijuana. Reduces from a felony with a maximum five years imprisonment to a misdemeanor with a maximum six months imprisonment the penalty for a second conviction of marijuana possession. Reduces from a maximum 20 years to a maximum two years the penalty for a third conviction of marijuana possession. Reduces from a maximum 20 years to a maximum eight years the penalty for a fourth or subsequent offense. Limits to two years the use of a first marijuana possession conviction for the purpose of enhancing subsequent offenses. Creates a new offense of knowingly or intentionally possessing two and one half pounds but less than 60 pounds of marijuana.
