Description:
An Order in Council was passed on January 8, 1908, declaring that “whenever in the opinion of the Minister, the condition of the labour market in Canada is such as to…render [it] necessary…immigrants may be prohibited from landing or coming into Canada unless they come from the country of their birth or citizenship by a continuous journey and on through tickets purchased before leaving the country of their birth or citizenship.” This OIC was eventually disallowed by the BCSC (in the matter of the arrival of S.S. Monteagle in February 1908 carrying 200 passengers, 105 of whom had boarded in Calcutta) because it was found that the Governor in Council did not possess such authority to make this type of regulation under the Immigration Act. This case where this OIC was quashed was Re Lal (In Re Behari Lal et al.) 1908 CarswellBC 87, 13 B.C.R. 415.
