Description:
This cases started when a former assemblyman Benjamin Gitlow and his associate Alan Larkin were arrested by policeman in New York claiming to have committed criminal anarchy. Both of these men were members of the Communist Party and are publishers of a radical newspaper called The Revolutionary Age and published “The Left Wing Manifesto”. This print contain information of a radical overthrow of the government. During the trial Gitlow argued no following violence followed to publishing of the article, he was still convicted. In the end, The Supreme Court ruled that the first amendment rights to freedom of speech also applied to State government as well.
