Description:
Olmstead was convicted on conspiracy to import, possess, and sell liquor using evidence of phone calls gathered using wiretaps placed outside of his home.
The Supreme Court had to decide if evidence gathered using wiretaps to listen to private conversations was a violation of the Fourth Amendment.
The Court held this was not in violation as it did not constitute a search and seizure of a "physical object" according to the language used in the Fourth Amendment.
