4 März 1998 Jahr - Oncale v. Sundowner Offshore Services, Inc. (1998)
Beschreibung:
Oncale was an employee of the Sundowner Offshore Services and alleged he was repeatedly sexually harassed by coworkers sharing explicit ways they would rape him. He quit and filed a lawsuit under Title VII of the Civil Rights Act of 1964, claiming he was discriminated based on sex. However, lower courts ruled same-sex harassment was not included under Title VII and dismissed Oncale's case.
Oncale brought the case to the Supreme Court who ruled unanimously in his favor, deciding Title VII does include same-sex harassment. This was due to the goal of Title VII at reducing workplace harassment in general, which encompasses sexual harassment between any genders. The cases would have the same standard of proof regardless of the genders.
