1985: City of Cleburne v. Cleburne Living Center deployed the 14th Amendment to decide that the city’s zoning ordinances violated the Equal Protection Clause. The city’s use of classification in treaty group homes is only constitutional as long as its rational, because of differences between disabled people. The city, however, could not discriminated against group homes for people with disabilities simply based on stereotypes and prejudice.
