When the Spanish began their conquest of Central and South America, they used Indigenous people in the Encomienda system, which saw forced labor instituted upon the natives in order to gain more economic prosperity. Encomienda's were granted to the Spanish Conquistadors by the Spanish crown as rights to a certain portion of land and people, which were expected to produce various goods and resources like gold and agriculture. In return the Conquistadors were meant to provide their enslaved workers with protection, education and religious instruction which is most cases was overlooked. Through this brutal system and the spread of disease introduced by the Europeans, most Indigenous people were killed or unable to work, forcing the need for a new labor supply which the Spanish found in the people of West Africa. It was in 1574 where the Spanish set up regulations for the treatment of the native people after much pressure from other governments over their treatment of the Indigenous people.

These regulations included:

Prohibiting the enslavement of indigenous peoples without just cause.

Limiting the power of encomenderos and requiring them to provide fair wages and treatment to indigenous laborers.

Mandating the provision of education and religious instruction to indigenous communities.

Establishing legal protections for indigenous lands and resources.

Prohibiting the forced relocation of indigenous communities without proper justification.

The regulations also sought to address issues related to intermarriage between Spaniards and indigenous peoples, inheritance rights, and the administration of justice in indigenous communities
