Exact date unknown, however during the deposition of Eric George, Ben Chew stated that communications of 12 December were conducted in light of ‘the opposing side… had just taken the position that it did not want a judge pro tem sitting as an arbitrator to confidentially resolve the disputes between Ms. Heard and Mr. Depp, raising a bigger issue, but that's what had just occurred.’

This may have been the Motion to Dismiss or a further filing as part of that action - in other words the Motion to Dismiss was filed on or before 12 December 2018.
