A female communist group organizer was prosecuted under the Criminal Syndicalism Act for helping to organize a group that sought to achieve societal changes with the use of violence. Whitney argued that the law was unconstitutional and that since she did not know that there was intended violence she could not be prosecuted. The Court unanimously upheld the law and sustained her conviction.
