Summary:
Quianna Vigil connected police to remove her husband, Jaime Ceballos, from their driveway because he was acting erratically and she feared for her and her daughter’s safety. Two of Ceballos’ friends told officers he was likely inebriated, but the officers refused to engage with the friends. Ceballos approached officers William Husk, who had drawn his gun, and Officer Ward, who drew a Taser. Ceballos was confirmed to have been resistant to the officers’ warnings to stand down, and the officers fired their respective weapons and killed Ceballos. His family accused Husk of excessive force and wrongful death, and the city of not adequate training Husk.
Decision:
Husk was denied qualified immunity from his actions, and the case should be tried before a jury.
