Dred Scott V. Sandford raised the controversial issue of congress’s constitutional authority over slavery. Dred Scott was an enslaved African American who lived for a time with his owner in a free state. Scott claimed that residence in a free state and a free territory had made him free, he was declared a slave still because seven of the nine justices declared so but they disagreed on the legal rationale. This helped lead to the Civil War because many people believed that Dred Scott was supposed to be a free man.
