6 März 1819 Jahr - McCulloch v. Maryland

Beschreibung:

Key Event: The case of McCulloch v. Maryland is a key event in U.S. history as it had helped further develop our government system of Federalism which we have today.

Defined: The state of Maryland had taxed the second bank of the United States (BUS) with hopes that it would financially collapse. In response, the second BUS had sued Maryland and won their case.

Described: Shortly after the United States was founded, the new government had to determine how they would pay the debt incurred from fighting in the Revolutionary War. The Bank of the United States (BUS) which would be run by the federal government was suggested by Federalist Hamilton, but Democratic-Republican Thomas Jefferson argued that centralization put the country’s democracy at risk. The state of Maryland had sided with Thomas Jefferson because the power to create a national bank was not explicitly in the Constitution. When the second BUS was created, Maryland’s government was infuriated, wanting to destroy the establishment.

Short Term: McCulloch v. Maryland proved that the Federal government is supreme to state governments or that Federalism is an important practice; In court, the second BUS was a Federal establishment that was deemed constitutional and did not have to pay Maryland’s state tax.

Long Term: The case had developed a precedent for future cases, suggesting that Congress can do whatever it wants as long as the Constitution does not prohibit their specific actions.
