2 Jan 1819 Jahr - McCulloch vs Maryland

Beschreibung:

This case was originally fought over the ability for the state of Maryland to tax the National Bank's Baltimore branch. The Supreme Court found that not only did the states not have the right to tax the National Bank, but that the national government was supreme over the states' governments. It was also decided in the case that Congress had implied powers.

This case not only established the supremacy of the national government over any other level, but it also stretched Congress' powers further than the constitution based on the interpretation of Article I, Section 8 of the Constitution: “make all laws necessary and proper for carrying into execution the foregoing powers.”
