After the death of her late master John Mottram in 1655, the overseers of his estate classified Elizabeth Key Grinstead and her infant son John as Negro slaves, not indentured, and thus part of their estate. Unwilling to accept permanent servitude, Elizabeth Key Grinstead became the first African woman to sue for and win her freedom in the Colony of Virginia. She sued based on the fact that her father was an Englishman and that she was a baptized Christian. According to English law, a person's legal status, whether free or enslaved, was determined by the status of their father. Eventually, Elizabeth Key Grinstead won freedom for herself and her infant son, John.
